The countries that completely don’t allow the use of kratom substances are the following:

  • Australia
  • New Zealand
  • Myanmar
  • Lithuania

Below are the countries that do not completely prohibit the use of kratom but place it under strict government supervision:

  • Poland
  • Denmark
  • Sweden

The Ban on Kratom: A Closer Look

  • Malaysia – The government of Malaysia requires a license to plant and sell kratom. But the country doesn’t issue a license for kratom, thus making it illegal. Illegal possession of kratom substances in Malaysia can cause you to be imprisoned for up to four years.

  • Thailand – Though kratom originates from Thailand, possession of kratom leaves in Thailand is completely illegal. This action was made effective by Kratom Act 2486 that prohibits the planting of kratom. The country classifies kratom as a Category V narcotic along with marijuana.
  • Australia and New Zealand – The two countries consider kratom as a narcotic substance. In New Zealand, it is a narcotic under the Medicines Regulation of 1985. Australia didn’t ban the planting of the kratom tree or any Mitragyna Speciosa tree in Australian soil. But the Australian government prohibited kratom due to its potential for abuse.
  • Myanmar – The country completely made the plant, the leaf, and related substances illegal. Selling, planting, and growing of Mitragyna Speciosa trees and leaves, and selling processed Kratom products anywhere in Myanmar is considered illegal.
  • Poland – The country requires a prescription and a license for you to be able to purchase kratom products. The rules of Poland are rigid, and users of kratom should be very careful.
  • Denmark – In 2009, kratom was legal in Denmark. The sale and possession of kratom substances didn’t have legal restrictions and penalties. But now, the country has imposed legal restrictions on this substance.
  • Lithuania – The country completely prohibits the use of kratom. Planting and growing Mitragyna trees are illegal. Selling and possessing kratom substances are illegal as well. If caught, you are subject to a criminal offense.
  • Sweden – Because of the Psychoactive Substances Act, the selling, growing, and planting of kratom leaves and substances are illegal in the country. This government action was a result of the nine kratom-related deaths that happened in 2010 and 2011.

Legality of Kratom in the United States

In the United States, some states paved the way for kratom’s legality. However, some states have not legalized kratom. These states are:

  • Vermont
  • Rhode Island
  • Washington D.C.
  • Alabama
  • Arkansas
  • Indiana
  • Wisconsin

In some states, the legality of kratom is limited. Below is the list of states where kratom is illegal in some of their areas:

  • Denver – Colorado
  • Florida – Sarasota County
  • California – San Diego
  • Illinois – Jerseyville
